Terms of Service

Welcome to ShakenApp. These Terms of Service ("Terms") govern your use of the ShakenApp mobile application (the "App") operated by True Story Limited ("we", "our", or "us"). By using the App, you agree to these Terms.

1. Eligibility

You must be at least 21 years of age (or the legal drinking age in your jurisdiction) to use this App. By using the App, you represent that you meet this age requirement.

2. Account Registration

  • You may need to create an account to access certain features.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when creating your account.
  • You are responsible for all activities that occur under your account.

3. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws.
  • Attempt to gain unauthorized access to the App or its systems.
  • Interfere with or disrupt the App or servers connected to it.
  • Use the App to transmit harmful code or malware.
  • Scrape, copy, or reproduce content from the App without permission.
  • Use the App in any way that could harm minors.

4. Content and Recipes

  • Our Content: Recipes and content provided in the App are for personal, non-commercial use only.
  • AI-Generated Content: The App uses AI to generate cocktail suggestions and recipes. These are provided "as-is" and we do not guarantee their accuracy, safety, or suitability.
  • Your Content: You retain ownership of content you create (notes, custom recipes). By using the App, you grant us a license to store and display this content to provide the service.

5. Subscriptions and Payments

  • Some features require a paid subscription ("Premium").
  • Subscriptions are billed through the App Store or Google Play.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Refunds are handled according to Apple's or Google's policies.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted or error-free.
  • Recipe suggestions will be accurate, safe, or suitable for your needs.
  • AI-identified ingredients will be 100% accurate.

Important: Always verify ingredients before consuming cocktails, especially if you have allergies. We are not responsible for any adverse reactions or injuries resulting from recipes or suggestions provided by the App.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

8. Responsible Drinking

ShakenApp encourages responsible alcohol consumption. Please:

  • Drink responsibly and in moderation.
  • Never drink and drive.
  • Be aware of local laws regarding alcohol consumption.
  • Seek help if you or someone you know struggles with alcohol.

9. Intellectual Property

The App, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may delete your account at any time through the App settings.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by other means. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
